Following the Parish Council’s agreement to the proposed compromise of diverting Footpath A on the non-negotiable condition that all the other routes: B, C, D and E are open before or concurrently with the proposed diversion, we have subsequently been advised that the Landowner has additionally demanded to remove entirely Footpath D, otherwise all his objections would stand. In this case the matter would go to the Planning Inspectorate.
In consultation with the footpath group the Parish Council reject the proposal to remove Footpath D. CWaC do not have any powers to remove Footpath D without going through the full application process which would likely be subject to objections.
CWaC have already carried out extensive investigations and arrived at the legal view that all the
paths covered by the original applications should be registered on the definitive map. The Parish
Council therefore support the Footpath group’s intention to advise CWaC that unless the landowner opens all the footpaths, including the Diverted Path A, within 14 days they will revert to the original applications going to a public inquiry.
